1. introduction

1.1 Incuspaze Solutions Private Limited (hereinafter referred to as “Incuspaze”, “Company”, “It”, “We”, “Us” or “Our”) a private limited company, duly incorporated under the Indian Laws, having its registered office located at Ground Floor, Plot No. 13, Udyog Vihar Phase IV, Sector – 18, Gurugram – 122015, Haryana, is inter-alia engaged in the business of developing and providing managed office solutions, co-working space solutions and serviced offices services (“Services”) that provide office spaces along with value added services for the incremental productivity of the employees of our clients.

1.2 These Terms of Use (“Terms”) have been framed in compliance with the Information Technology Act, 2000 and rules made thereunder, as amended from time to time. These Terms are electronically generated and do not require physical signatures.

1.3 The website (www.incuspaze.com) and the mobile application available on the Play Store (Android) and the App Store (iOS) (collectively referred to as the “Platform(s)”) is developed, owned and operated by Incuspaze. Your continued access or use of the Platform constitutes acceptance of these Terms.

1.4 The Privacy Policy and the physical agreement for Services form an integral part of these Terms. In case of conflict, the physical agreement for Services shall prevail.

1.5 Any use of the Platform shall be deemed an irrevocable consent to be bound by these Terms. If you do not agree, you must cease using the Platform immediately.

1.6 All information published on the Platform is proprietary to Incuspaze. Any unauthorized reproduction or dissemination is prohibited.

1.7 Information on the Platform does not constitute legal, financial, tax or investment advice. Users must exercise independent judgment before entering into any transaction.

2. applicability

2.1 These Terms apply while accessing the Platform or Services, including:
2.1.1 Services provided by Incuspaze such as meeting rooms, event spaces, hot desking, service requests, ticketing and visitor management.
2.1.2 Services provided by affiliates including food, housekeeping, concierge and creche facilities.
2.1.3 Services provided by third parties including food, events and creche facilities.

3. user registration and access

3.1 Registration may be required to access Services. You are solely responsible for maintaining confidentiality of your login credentials.

3.2 You agree to provide accurate information including name, email and mobile number.

3.3 Posting unlawful, defamatory, pornographic or infringing content is strictly prohibited.

3.4 You are responsible for all activity conducted through your account.

3.5 You shall not post abusive, threatening or confidential information.

3.6 You shall not disrupt the Platform or transmit malware or viruses.

4. privacy policy

4.1 The Privacy Policy governs the collection and use of personal information and forms an integral part of these Terms.

5. your consent and license

5.1 Incuspaze grants a limited, non-transferable, non-commercial license to access and use the Platform.

5.2 No ownership rights are transferred to you.

5.3 All intellectual property on the Platform belongs to Incuspaze or its licensors.

5.4 Unauthorized use may result in termination of access.

6. third party links

6.1 The Platform may contain links to third-party websites. Incuspaze is not responsible for such content.

7. disclaimer

7.1 The Platform is provided on an “as is” and “as available” basis without warranties of any kind.

7.2 Incuspaze disclaims all warranties including merchantability and fitness for purpose.

8. limitation of liability

8.1 Incuspaze shall not be liable for any indirect, incidental or consequential damages.

9. indemnification

9.1 You agree to indemnify Incuspaze against all claims arising from your use of the Platform.

10. miscellaneous

10.1 These Terms constitute the entire agreement between you and Incuspaze.
10.2 Invalid provisions shall not affect remaining Terms.
10.3 These Terms are governed by Indian laws and courts at Gurugram, Haryana shall have exclusive jurisdiction.
